Well… no win , no loss, no tie… still waiting!

Court was as to be expected… a slightly long drawn out affair… In the end on friday just before moon when we finally got out of the building we only had in hand, the next date… Yes we have to wait another ten days to find out the determination of rather we will remain in criminal court or get PUSHED over into civil court…

The states position is that this is civil and that we should not be riding on the coattails of the government to have them pay for our case… Well, i will refrain from the many comments at THIS time…

I will say however that when thinking of civil, for example when one ownes a pet, and fails to produce the appropriate verification of a rabies shot… Well for that infraction of a civil code, you are fined. When one fails to register you are arrested and charged with a level 6 person felony… Its difficult here to make a case that KORA is NOT punitive, and therefor belongs in the criminal court system that sentenced all these individuals.

Anyway its late, I will write more Sunday…

New court is April 30th at 1 30 pm…

And we had a decent turnout, but really really need more of you to show up and show support.. this is your freedom your fighting for…I want to see that court room filled with individuals willing to stand up and say no to RETROACTIVE SB37… There has been approx a 95% plea bargain rate on ” sex offences” here in Sedgwick county.. and we all know why… coz ya all were scared… I KNOW I WAS… SO it was easier to just take a plea, regardless of facts and get the hell on down the road..But this isnt about 3 yrs probation and ten yrs of registering… This is about another 15 yrs to life registering, and a litany of future law changes that we will be forced to adapt to, and who knows how far these laws may go…Keep in mind the problems they are having in states like Iowa, Georgia and Florida with the residential zoning laws… Well we also have a law like that currently sitting in the House of Appropriations, waiting to be voted on probably not until next legislative session… BUT STILL…. Do NOT wait around and take the chance to find yourself getting told you have to move out of your home that you own because its to close to a church, school, park , bus stop, day care or some other place children are known to congregate…

  1. DAYTON, Ohio — Court rulings and loopholes have hampered enforcement of Ohio’s sex offender law with some offenders able to legally live near schools or day care facilities, a newspaper reported.
    More than 80 percent of the 139 adult registered sex offenders in Greene County live within a mile of a school or day care, according to a review by the Dayton Daily News (http://bit.ly/HRzP3a).
    Sixty-three of more than 1,000 registered sex offenders in Montgomery County live within 1,000 feet of a school or day care but are not subject to the law, the newspaper found. Fifty-four committed their offense before changes in the law and nine are juvenile offenders not subject to the boundary.
    Several living within 1,000 feet of schools or day care facilities do so legally because they committed an offense before a law change or because they owned their house before committing a sex crime, the newspaper reported.
    The Ohio Supreme Court has ruled multiple parts of the state sex-offender law unconstitutional following its passage in 2008 to comply with the federal Adam Walsh Act. The rulings found that sex offenders couldn’t be subjected to guidelines retroactively since that may violate the U.S. Constitution’s due process and double jeopardy clauses.
    The latest of three court decisions was an April 3 ruling striking down part of Ohio’s sexual offender law that subjects juvenile offenders to mandatory, lifetime sex-offender registration and notification requirements.
    The American Civil Liberties Union of Ohio has said it supports prosecution and conviction of sex offenders, but also says they are entitled to some basic constitutional protection.
    One registered sex offender living within 1,000 feet of a day care in a Fairborn church was told to move after a Daily News inquiry. The offender had been living in violation since January, when he told officials that his stay would be temporary.
    That same offender pleaded guilty in Clark County of trying to solicit sex from a Springfield police officer posing as a 14-year-old girl. Authorities found 138 images of child pornography on his computer. He also was found guilty in 2009 in Greene County of illegal use of a minor in a nudity-oriented material or performance.
    A registered sex offender who lives near a middle school in Fairborn fought an effort to be removed from his home in 2005, and a magistrate ruled the 1,000-foot rule didn’t apply since he’d lived there for decades before his offense.
    Residents can keep track of registered sex offenders by using search engines available on county sheriffs’ websites. Email alerts can be sent by registering on those websites, and cards are mailed out to schools and day cares when an offender moves nearby.
    Greene County Adult Probation Director Melissa Litteral encourages parents to monitor the sexual offender registry.
    “If I had little kids, I’d be looking at it,” she said.
    Offenders often are cited for failure to register, and Greene County Sheriff Ron Van Nuys says authorities are “always fighting a battle because these guys are always playing games and trying to mislead.”
